Registration Criteria According to Categories of Constructors & Operators

PEC allows registration as a constructor or operator in six different categories, which differ mainly by the limit of construction cost of project to be constructed or capital cost of project to be operated. For registration in any of the categories mentioned (in Column '1' of the tables below), one has to fulfill the criteria listed in Columns 2,3,4,5 and 6 of the corresponding category.

Note: - Construction cost of a project shall exclude cost of land, plant and machinery permanently installed in the works but shall include cost of erection, installation, testing and commissioning.

Note: - Capital costs of projects and other values in the above table are based on the value of the operators fees.


For definitions of terms used in the above tables, please see the 'Definitions' Section of the Engineering Works Bye Laws.

In addition to fulfilling the above laid criteria, it is essential to quote here the following Bye Law that identifies ineligibilities for registration:

Engg Works BYELAW 4, Clause 6:

No constructor's or operator's license shall be granted by the Council to such persons, firms-and companies who: -

  1. are declared bankrupt and are not rehabilitated;

  2. are adjudged incompetent or quasi-competent by the Council;

  3. have acted in a manner such that their previous license has been cancelled for any reason whatsoever until the Council is satisfied that the causes of previous cancellations of license have been removed;

  4. have been dismissed at nay time from employment for corruption, fraud or moral turpitude;

  5. have committed professional misconduct;

  6. violate the limitations prescribed by the license and the requirements of professional content of the licensee's organization as prescribed; and

  7. fail to pay the prescribed license fees or the charges for violations in accordance with these byelaws:

Provided that the persons who are directors of such companies, which are under liquidation, shall not be affected by the provisions of this byelaw unless such person, as individuals, are declared to be bankrupt.
